Terms of Service

1. Acceptance

By downloading, installing, or using Pocket Wombat, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use Pocket Wombat. The App Store’s own terms apply to the download and the transaction; these terms govern your use of the app itself.

2. Platforms

Pocket Wombat is one product, available on:

There is no iPad, Mac, or Watch app in version 1.0. Features that depend on Apple Intelligence, Weather, Health, or similar system frameworks are available only on supported devices and OS versions.

3. License

Pocket Wombat grants you a personal, non-exclusive, non-transferable license to use the app on devices you own or control. You may not redistribute the app, rent it, sublicense it, or provide it as a service to others. You may not reverse engineer it beyond what applicable law allows (including New Zealand’s permitted exceptions).

You retain all rights to the notes, sketches, photos, voice recordings, and other material you put in a pocket. Pocket Wombat does not claim any ownership or licence over your inputs, except the limited technical need to run the app on your device. Delete the app and the journal in the sandbox is gone; copies you exported or emailed are still where you put them.

4. Your journal

The day lives on the phone you wrote it on. There is no Pocket Wombat cloud and no iCloud sync of the journal in version 1.0. Content leaves the device only when you share it, email it, or send it through Ask Wombat with a cloud key.

You are responsible for what you put in a pocket. Pocket Wombat will not store content you do not have the right to capture, and the licence above does not grant you any new rights over third-party material.

Back up anything you cannot afford to lose. Deleting the app can delete local data.

5. Purchase

Pocket Wombat 1.0 is a paid app. It is a one-time payment, not a subscription. There is no in-app purchase to unlock the journal. There is no free-credit tier.

The list price is USD $6.99. Apple may surface a region-localised price at the point of purchase. We do not have a promotional code, discount, or trial system at the moment.

Optional cloud Ask (bring your own key) may incur charges from Anthropic, OpenAI, OpenRouter, or another provider you choose. Those charges are between you and that provider. They are not included in the App Store price.

6. Refunds

Refunds are handled entirely by Apple through the App Store. You can request a refund at reportaproblem.apple.com or through the App Store app. Pocket Wombat cannot issue refunds directly and will not process them outside of Apple.

Apple may grant or decline the refund at its discretion. Because this is a paid app, the App Store rules on refund eligibility apply.

7. StoreKit and the App Store

Pocket Wombat uses Apple’s StoreKit framework. Apple is the merchant of record. We receive that you bought the app, but do not receive your Apple ID, payment instrument, or billing address. Apple’s terms at apple.com/legal/internet-services/itunes apply to the purchase itself.

These Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for Pocket Wombat. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price to you; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing claims relating to the app or your possession and use of it, including product-liability claims, consumer-protection claims, or claims that the app infringes a third party’s intellectual property.

You represent that you are not in a country subject to a US Government embargo, or on a US Government prohibited or restricted-party list, to the extent Apple requires that representation.

Apple and Apple’s subsidiaries are third-party beneficiaries of this section and of these Terms as they relate to the App Store. Upon your acceptance, Apple will have the right to enforce them against you as a third-party beneficiary.

You must also comply with any applicable third-party terms when using the app (for example a wireless-data agreement).

8. Ask Wombat

Ask Wombat can summarise a pocket, extract follow-ups, or answer a question about the day. Output can be wrong, incomplete, or stale. It is a writing aid, not professional advice. You decide what to keep.

Apple Intelligence (when available) runs on-device under Apple’s terms.

If you paste an API key for Anthropic, OpenAI, or OpenRouter, each Ask may send that day’s notes, calendar context, and stream text to the provider you chose. You must have a valid key and you accept that provider’s terms. We are not responsible for their availability, charges, retention, or model output. Do not send secrets you are not willing to give that provider.

9. Health, weather, and other sources

Optional stream sources (Health, Bluetooth, Photos, Music, HomeKit, Weather) are off until you turn them on. Now Playing and Device state are on by default; you can turn them off.

Health rows are for your journal. Pocket Wombat is not a medical device and does not provide diagnosis, treatment, or clinical advice.

Weather, when enabled, uses Apple Weather. Attribution: weatherkit.apple.com/legal-attribution.html.

Calendar and Reminders depend on EventKit and the access you grant. We are not responsible for events or tasks you create, miss, or mis-schedule.

10. Privacy

The Privacy Policy is part of these Terms. If a new data flow, a new third-party SDK, or a new destination server appears, the Privacy Policy will be updated and, for substantial changes, a notice will appear in the app.

11. Intellectual property

Pocket Wombat, the wombat character, the doodle icons, the iOS code, the website copy and assets, and the Pocket Wombat trademarks are owned by Matthew Worner or are used under licence (including Playfair Display, SIL Open Font Licence). You may not redistribute, decompile (beyond what applicable law allows), or commercially resell the app or its components.

You retain all rights to the material you put in a pocket. See §4.

12. Changes

We may update these Terms from time to time. Material changes — a new data flow, a new charge model, a change in licence scope — will be surfaced in the app and bumped at the top of this page. Editorial changes that don’t change the substance won’t be announced. Your continued use of Pocket Wombat after a material change is your acceptance of the new Terms.

13. Termination

You can stop using Pocket Wombat at any time by deleting the app. We can stop offering Pocket Wombat at any time, with or without notice; if we do, we will not have access to your journal, and Apple will manage any refund through the App Store.

Deleting the app does not automatically delete copies you exported.

14. Disclaimer and limitation of liability

Our total liability arising out of the app or these Terms is limited to the amount you paid for the app (USD $6.99 or the equivalent you actually paid Apple), except where New Zealand law requires a different result.

If you are a New Zealand consumer, you may have non-excludable rights under the Consumer Guarantees Act 1993 and the Fair Trading Act. Nothing in these Terms limits those rights.

The journal is a pocket. It is not a medical record, not a calendar of record, and not a substitute for a lawyer, a doctor, or a backup. Ask Wombat is a writing aid. Use your judgement.

15. Governing law

These Terms are governed by the laws of New Zealand, without regard to its conflict-of-law provisions. Nothing in this section limits any consumer-protection law that applies in your jurisdiction.
